Terms of Service for ModelView 3D for Bitbucket

Welcome to ModelView 3D for Bitbucket ("ModelView 3D", "the app", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of ModelView 3D, an Atlassian Forge app for viewing and reviewing 3D model files in Bitbucket Cloud. By installing, accessing, or using the app, you agree to these Terms and our Privacy Policy.

1. Use of the App

• ModelView 3D is provided for repository file viewing, 3D model inspection, and pull request review workflows in Bitbucket Cloud.
• You may use the app only in accordance with these Terms, Atlassian's applicable terms, and all applicable laws.
• You are responsible for your Bitbucket workspace, repositories, files, access permissions, and user activity.
• You may not attempt to misuse, overload, disrupt, reverse engineer, bypass licensing, or interfere with the app or Atlassian services.

2. Atlassian and Bitbucket

• The app is built for Bitbucket Cloud and runs on Atlassian Forge.
• Your use of Bitbucket Cloud, Atlassian Forge, Atlassian Marketplace, and Atlassian accounts is also governed by Atlassian's own terms and policies.
• We are not responsible for Atlassian service outages, platform changes, API changes, permission changes, Marketplace billing issues, or Bitbucket repository availability.

3. Supported Functionality

ModelView 3D may support viewing and reviewing file formats such as GLTF, GLB, OBJ, and STL. Support can vary by file structure, browser, file size, Bitbucket permissions, and model features.

• GLB is generally the best-supported format.
• GLTF files may require relative companion resources such as .bin files and textures.
• OBJ and STL support may be geometry-only.
• Some features, such as DRACO compression, KTX2/Basis textures, OBJ material libraries, or other model extensions, may be unsupported.
• The app may show errors or reduced functionality for unsupported, missing, inaccessible, malformed, or oversized files.

4. Customer Content

• You retain ownership of your repositories, model files, source files, textures, pull requests, and other customer content.
• The app accesses customer content only as needed to provide viewing and review functionality.
• You are responsible for ensuring you have the rights and permissions needed to store and process your content in Bitbucket and through installed apps.
• You should not use the app with content that you are not authorized to access, process, or review.

5. Privacy and Data Handling

Our data practices are described in the Privacy Policy. In summary, the app is designed so model data stays within Atlassian infrastructure and the user's browser. We do not upload model files, textures, source files, or rendered previews to our own servers.

6. Licensing, Purchases, and Subscriptions

• The app may be offered as a paid Marketplace app or under another licensing model described in the Atlassian Marketplace listing.
• If the app is offered through Atlassian Marketplace, billing, trials, renewals, cancellations, and refunds may be handled according to Atlassian Marketplace terms and processes.
• If the app is offered under a vendor-managed commercial arrangement, the applicable ordering document, invoice, or subscription terms may also apply.
• Access to paid functionality may require an active license or subscription.
• We may change pricing, packaging, licensing, or included features for future subscription periods or new customers, subject to applicable Marketplace rules and law.

7. Support

Support is provided through the support contact listed on the Atlassian Marketplace listing or by email at [email protected].

Support may require you to share error messages, screenshots, or copied diagnostics. Do not send confidential model files, source code, access tokens, or secrets unless specifically requested through an agreed secure channel.

8. Changes and Updates

• We may update the app to fix bugs, improve performance, add features, remove features, address security issues, or adapt to Atlassian platform changes.
• Features may change or become unavailable over time.
• Continued use of the app after an update indicates acceptance of the updated app behavior and any updated Terms posted on this page.

9. Service Availability

• The app is provided on an "as is" and "as available" basis.
• We do not guarantee uninterrupted, error-free, or permanently available operation.
• Service interruptions may occur due to browser issues, WebGL limitations, Bitbucket permissions, Atlassian outages, app bugs, network issues, unsupported model files, or third-party platform changes.

10. Intellectual Property

• ModelView 3D's name, design, code, documentation, original content, and related materials are owned by Ugurcan Sari or licensed third parties.
• You may not copy, resell, redistribute, sublicense, or reproduce the app or its original materials except as allowed by applicable law or written permission.
• Atlassian, Bitbucket, and Forge names and marks belong to Atlassian or its affiliates.
• Third-party libraries and model formats are subject to their own licenses and terms.

11. Prohibited Use

• You may not use the app to violate laws, infringe rights, or access content without authorization.
• You may not attempt to bypass license checks, Forge permissions, Bitbucket permissions, or Marketplace restrictions.
• You may not use the app to introduce malware, malicious files, harmful content, or abusive traffic.
• You may not use automated activity to overload the app, Bitbucket, Atlassian Forge, or related APIs.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the app is provided without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or error-free operation.

13. Limitation of Liability

To the maximum extent permitted by law, Ugurcan Sari shall not be liable for direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to use of the app, inability to use the app, service interruptions, unsupported files, rendering errors, data loss, business interruption, lost profits, or reliance on app output.

14. Indemnity

You agree to indemnify and hold harmless Ugurcan Sari from claims, damages, liabilities, costs, and expenses arising from your misuse of the app, violation of these Terms, violation of law, or infringement of third-party rights through content you access or process with the app.

15. Termination

We may suspend or terminate access to the app where required by law, Atlassian Marketplace rules, security concerns, non-payment, license expiration, or violation of these Terms. You may stop using the app at any time by uninstalling it from your Bitbucket workspace or ending your subscription where applicable.

16. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, unless mandatory consumer protection laws in your country require otherwise.

17. Changes to These Terms

We may update these Terms from time to time. Updated versions will be posted on this page with a revised effective date. Material changes may also be reflected through Atlassian Marketplace listing updates or other appropriate notice.
